GlobalSpace Solutions, LLC Hosting Policies

GlobalSpace Solutions, LLC and its resellers provide web hosting to hundreds of clients and together have a responsibility to protect each client and provide the best services available. The following guidelines were established by GlobalSpace Solutions, LLC to ensure the integrity of these services.

GlobalSpace Solutions, LLC, and its customers and resellers, agree to adhere to these policies.
User-Supplied Content
All services may be used for lawful purposes only. Through GlobalSpace Solutions, LLC's Service, you may have access to Chat Areas, Bulletin Boards, Web Pages, eMail, or other Services that enable you to send or post materials ("content") and make that content available to others. You must not submit, publish, or display on the Network any defamatory, inaccurate, abusive, obscene, infringing, or threatening content. In addition, you may not submit, publish, or display any content that violates any US Federal, State, or Local Law. You are solely responsible for the content you make accessible through the Network. You may not use the Service to assist any other person or entity to violate any Federal, State, or Local Laws, Ordinances or Regulations.

GlobalSpace Solutions, LLC is not obligated to monitor the Network to examine available content. You hereby acknowledge that if we are made aware of content that is determined to be, in its sole discretion, unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, GlobalSpace Solutions, LLC has the right, but not the obligation, to edit, remove or deny access to such content. GlobalSpace Solutions, LLC may disclose any content or records concerning Customer's account as required to satisfy any Law, Regulation, Governmental Request or Court Order.

Pornography and sex-related merchandising are prohibited on all GlobalSpace Solutions, LLC Servers. This includes Sites that may infer sexual content, display nudity, or link to adult content elsewhere. This is also true for Sites that promote any illegal activity or content that may be damaging to GlobalSpace Solutions, LLC's Servers or any other Server on the Internet. Links to such materials are also prohibited. In addition, any Site Selling or promoting Bulk eMail Service is not allowed.

Below are some examples of non-acceptable content or links:

Adult Sites - Any erotic or pornographic material, links to adult sites, or advertisements for adult sites.

Pirated Software (Warez) - Any software that is copyrighted and not freely available for distribution without cost; i.e. ROMs, ROM Emulators and MPEG Layer 3 files (MP3).

Copyright Violations - Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer.

Hacking/Phreaking - Includes sites with material, links, or resources for hacking, phreaking, viruses, anarchy, or any type of site that promotes or participates in willful harm to Internet Sites or Providers.

Monthly service charges
Customers may choose to be billed to their credit card or sent an invoice (to be paid by check). If the customer chooses the latter, payment must be received before services will be activated. Billing becomes effective the first day of account activation and is without exception paid 30 days in advance. Thereafter, customers will be charged on a recurring monthly basis. Declined credit cards and past due payments may result in immediate deactivation. Cancellation of accounts must received via email to: billing@GlobalSpace.net. Credits are not issued for unused current month previously billed, but we will be happy to keep your account active through the end of the current billing cycle. There is a $100.00 fee to restore web sites from back-up tape if they have been suspended for nonpayment or any other billing issue.
Domain registration will be faciliated on clients behalf via register.com or nameregistrars.com
In addition any site selling or promoting Bulk email services is not allowed

Web Site Content Provisions:
All services provided by GlobalSpace Solutions, LLC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. The subscriber agrees to indemnify and hold harmless GlobalSpace Solutions, LLC from any claims resulting from the use of the service which damages the subscriber or any other party.
Note: Pornography and sex-related merchandising are prohibited on any of our servers. This includes sites that may infer sexual content or link to adult content elsewhere. GlobalSpace Solutions, LLC will be the sole arbiter as to what constitutes a violation of this provision.

Traffic Guidelines/File Quota Guidelines
This is considered any transfer of information in the form of text or graphic, directly readable by a web browser. Additional bandwidth can be purchased if these limits are exceeded.
Our intention is to provide a large storage space to serve web documents, not an off-site storage area for electronic files. All web pages (HTML) must be 'linked' with files (.GIF, .JPEG, etc.) that are stored on our servers. Web sites that are found to contain either/or no HTML documents or a large number of unlinked files are subject to warning, suspension or cancellation at the discretion of our administration.
Each domain is limited to 15,000 files per account. If this allocation is exceeded, additional blocks may be requested for a monthly fee of $5.00 per 5,000 additional files.

Network Security
Customers may not use the Network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the Customer, logging into a Server or Account the Customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's Security Policy. Customers may not attempt to interfere or deny service to any User, Host or Network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a Host or Network. GlobalSpace Solutions, LLC will cooperate fully with investigations of violations of Systems or Network Security at other sites, including cooperating with Law Enforcement Authorities in the investigation of suspected criminal violations. Users who violate System or Network Security may incur Criminal or Civil Liability

CGI Scripts
Each account comes fully equipped with its own pre-configured CGI-Bin. Customers are free to use any CGI-Scripts provided with their account or add any additional ones they require. Any CGI-Scripts deemed to be adversely affecting the Server performance or the Network integrity may be shut down without prior notice. CGI-Script sharing with Domains not hosted by GlobalSpace Solutions, LLC is not allowed.

Chat Room Conditions:
We do not allow clients to install their own chat rooms. These tend to be large system resource hogs and in order to preserve a high quality for everyone we cannot allow this.

Server Resources
Any Web Site that uses a high amount of Server resources (such as, but not limited to CPU Time, Memory Usage, and Network Resources) will be given an option of either upgrading their service level or reducing the resource used to an acceptable level.

Background-running Progs:
We may allow programs to run continuously in the background. These are considered on an individual basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Commercial Advertising - Email:
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $100 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.
As such, any violation will result in immediate deactivation of services without refund.

Server Abuse:
Any attempts to undermine or cause harm to a server is strictly prohibited.

Loss of data or Server / domain downtime:
GlobalSpace Solutions, LLC is proud of its server speeds and reliability; however, we can not be responsible for advertising costs, loss of business or other damages resulting from domain or server downtime or loss of data. In addition, the servers are not intended to be a file storage facility. All files should be accessible by hyperlink to be considered of a non-storage nature. In all cases, each customer is responsible for maintaining a backup copy of all files maintained on the server.

Intellectual Property Rights
Material accessible to you through GlobalSpace Solutions, LLC's Services may be subject to protection under the United States or other Copyright Laws, or laws protecting Trademarks, Trade Secrets or Proprietary information. Except when expressly permitted by the owner of such rights, you must not use the GlobalSpace Solutions, LLC Service in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the Network. If you use a domain name in connection with the GlobalSpace Solutions, LLC Service or similar service, you must not use that Domain Name in violation of any Trademark, Service Mark, or similar rights of any third party.

Distribution and/or Transmission of Obscene, Indecent Speech or Materials
Violation of Indecency and Obscenity Laws can result in Criminal Penalties.

Defamation
Defamatory speech distributed over the Internet can result in Civil Lliability for the defamer.

Privacy Policy
GlobalSpace Solutions, LLC insures that all personal information being voluntarily submitted to us in the processing of your order (to be used for record and billing purposes, etc.), inclusive, but not limited to, credit card and other personal information, will be kept strictly confidential and used "solely" by GlobalSpace Solutions, LLC , its authorized representatives and employees; for the strict purpose for which it was intended, and for the benefit of the Subscriber. We agree not to share, rent, sell or release this information to any individual, entity or third party, for any reason, without the specific written consent of the Subscriber; with exception as required by Law, Regulation or Governmental Authority. Indemnification
Customer agrees that it shall defend, indemnify, save and hold GlobalSpace Solutions, LLC harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GlobalSpace Solutions, LLC, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GlobalSpace Solutions, LLC against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GlobalSpace Solutions, LLC server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement and any defective products sold to a Customer from GlobalSpace Solutions, LLC's Services.

Disclaimer
GlobalSpace Solutions, LLC will not be responsible for any damages your business may suffer. GlobalSpace Solutions, LLC makes no warranties of any kind, expressed or implied for services we provide. GlobalSpace Solutions, LLC disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by GlobalSpace Solutions, LLC and its employees. GlobalSpace Solutions, LLC reserves the right to change or update policies without notice

GlobalSpace Solutions, LLC furthermore expects that its Customers who provide Internet services to others will fully comply with all applicable laws concerning the Privacy of On-line Communications. A Customer's failure to comply with those laws will violate this policy. Finally, GlobalSpace Solutions, LLC wishes to emphasize that in accepting services, Customers indemnify GlobalSpace Solutions, LLC for the violation of any law or GlobalSpace Solutions, LLC policy, that results in loss to GlobalSpace Solutions, LLC or the bringing of any claim against GlobalSpace Solutions, LLC. This means that if GlobalSpace Solutions, LLC is sued because of activities of the Customer that violate any law, or this policy, the Customer will pay any damages awarded against GlobalSpace Solutions, LLC, plus costs and reasonable attorneys' fees.

Refusal of Service:
We reserve the right to refuse or cancel service at our sole discretion.

If any terms or conditions are failed to be followed it will result in grounds for account deactivation. We reserve the right to remove any account without notice if any terms or conditions applied above are violated. Violation of any of GlobalSpace Solutions, LLC's Rules and Regulations could result in a Warning, Suspension, or possible Account Termination. If such an occurrence was to take place, the fees for that month's service would not be returned the issuer.

We reserve the right to to modify or change any policies without notice at any time.
